1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and Ace In The Hole Spray Foam LLC ("Company," "we," "us," or "our"), concerning your access to and use of the aceintheholefoam.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service.

2. Services

Ace In The Hole Spray Foam LLC provides professional spray foam insulation services, including but not limited to:

• •Attic insulation
• •Crawl space insulation
• •Retrofit insulation
• •Energy efficiency consultations and estimates

All services are subject to a separate written service agreement and estimate provided prior to commencement of work.

3. Estimates and Pricing

Estimates provided through our website or by our representatives are based on information provided by the customer and are subject to change upon on-site inspection. Final pricing will be confirmed in a written estimate prior to any work being performed. Estimates are valid for 30 days from the date of issue unless otherwise stated.

Prices are subject to change based on material costs, project scope changes, or unforeseen site conditions discovered during installation.

4. Payment Terms

Payment terms will be outlined in your project estimate and service agreement. We accept payment via check, credit card, and electronic payment through QuickBooks. A deposit may be required prior to scheduling your project.

Invoices are due upon receipt unless otherwise agreed in writing. Late payments may be subject to a finance charge of 1.5% per month on the outstanding balance.

5. Cancellations and Rescheduling

Cancellations or rescheduling requests must be made at least 48 hours prior to the scheduled service date. Cancellations made with less than 48 hours notice may result in a cancellation fee. Any deposit paid may be forfeited for same-day cancellations.

6. Warranty

Ace In The Hole Spray Foam LLC warrants that all work will be performed in a professional and workmanlike manner in accordance with industry standards. Specific warranty terms, including duration and coverage, will be outlined in your service agreement.

Warranties are void if the insulated area is modified, damaged, or subjected to conditions outside normal use after installation. Manufacturer warranties on materials are separate from our labor warranty and are subject to the manufacturer's terms.

7. Limitation of Liability

In no event shall Ace In The Hole Spray Foam LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services or website. Our total liability to you for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of Ace In The Hole Spray Foam LLC. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wise County, Texas.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
